Executors
Your executor is the person you appoint to have the responsibility to ensure the wishes in your Will are carried out.
The executors of your Will should be persons you trust.
Your executors can be beneficiaries of your Will.
Witnesses and signing
The will is signed by the person making the will (i.e. you) in the presence of the witnesses (so that they are able to ‘witness’ the signing).
The Will is then signed by each witness.
You need to have 2 adult witnesses who are mentally capable.
You and the witnesses need to all be present in the same room at the same time.
The witnesses must not be blind.
The witnesses should not be beneficiaries or the executors of the will (or the spouse or civil partner of any beneficiary or executor).
Everyone signing should use the same pen.
Storing your Will
You can store your Will either with your bank in a safe deposit box or at home where you store your important papers (a fireproof box is recommended). Create a file with addresses and contact details of your beneficiaries and send this to your executor. Tell your executor where
your Will can be found.
